Scope and content

The Notarile moderno fonds comprises notarial records of the territory subject to Florentine jurisdiction after 1569. It includes deeds of notaries operating in the territories of Arezzo, Florence, Livorno, Lucca, Pisa, Pistoia and Siena. The fonds is divided into several series according to the document typology: Protocolli (protocols), Atti originali (original deeds), Atti rogati dai notai forestieri (deeds made by notaries outside Tuscany, but regarding residents of the Grand Duchy), Rogiti feudali (deeds regarding particular jurisdictional situations characterised by feudal ties), Mandate dei testamenti (copies of the mandates sent by notaries to the Archivio generale dei contratti); Testamenti segreti pubblicati and Testamenti segreti non pubblicati (an intermediate form between the holographic will and public will); Testamenti olografi pubblicati and Testamenti olografi inediti (wills handwritten and signed by the testator); Testamenti rogati dai notai forestieri (wills by foreign notaries); and Testamenti raccolti da preti o coram parocho. Public wills were drawn up in duplicate, and one copy was preserved in the Protocolli series and the other in the Atti originali.
These notarial records are an essential source to report the settlement and activity of Portuguese and Spanish Jews and conversos in Tuscan cities. Particularly interesting is the commercial information regarding Sephardic merchants that can be found in this fonds. For instance, Francesca Trivellato has explored the Notarile moderno to obtain information regarding some Sephardic merchants and companies operating in Livorno, such as the Ergas e Silvera company or Moses and Abraham Franco. Lucia Frattarelli Fischer also searched on this fonds data to reconstitute the trade networks involving Jews of Livorno (see Bibliography below). The fonds also includes several wills and testaments of Iberian Jews who lived and died in Tuscan cities. A general inventory of wills and testaments, "Repertorio generale dei testamenti", available in the archive in microfilm (M/4) is organised by year and testator name. The Testamenti rogati dai notai forestieri is also particularly interesting for those who study the Western Sephardic Diaspora, since last wills drafted by foreign notaries are deposited in translation in the Florentine office of public contracts.

Archival history

Following a provision issued on December 14, 1569, the notarial records of the territories under the jurisdiction of the Florentine State were gathered in the Archivio pubblico dei contratti (public archive of contracts). The Notarile moderno fonds was created in 1782 on the occasion of the reorganisation of the archive, when the records after 1569 were separated from the earlier documents. Then, new indexes organised by the notaries' surnames were drafted. The wills were also organised according to chronological criteria and bound in volumes.

Administrative / Biographical history

In the early 14th century, the municipality of Florence entrusted to the arte dei giudici e notai the task of supervising the conservation of the notarial deeds. In the following century, a deposit of deeds began to be formed in this guild. However, most of the notarial records continued to be kept by the notaries, who took up the deeds of their predecessors. The provision of December 14, 1569 established the Archivio pubblico dei contratti, a public archive to collect all the deeds produced by the notaries of the State of Florence.

Access, restrictions

The original deeds ("Atti originali") are not available for consultation, except for some particular cases, namely the lack of copies ("Protocolli") or the existence of documents attached to the original deed. Apart from these exceptions, only the copies could be consulted.
